Formed in early 1996, Kahnawake Gaming Commission (KGC) is one of the earliest regulatory bodies established for the sole purpose of licensing and legislating companies in the Mohawk Indian Territory of Tyendinaga, located South-East of Ontario, Canada. Kahnawake Gaming Commission implemented its Regulations Concerning Interactive Gaming in July 1999, followed by a transparent licensing scheme created in accordance with existing Kahnawake Gaming Law. KGC facilitates the issue and maintenance of all licenses for the 18,000 acre Mohawk Territory, additionally providing interactive game service hosting via subsidiary organization Mohawk Internet Technologies. KGC legislation is somewhat complex, however, they bear a stolid reputation for investigative procedures and company vetting prior to the issue of any license - qualities which have propelled the jurisdiction's renown for exemplary standards and commitment to player protection.

Kahnawake Gaming Commission offer three formats of licensing: a Key Person License; an Interactive Gaming License or a Client Provider Authorization License. The Interactive Gaming License is a requirement for all co-location companies seeking to operate from, or within the Mohawk Territory, available to both native and offshore gaming service providers. Holders of the Client Provider Authorization License may operate services under any parent brand/ company whom already bear an Interactive Gaming License issued by KGC. Key Person Licenses are a requirement for one, or several individuals appointed as head or ambassador for a parent or subsidiary brand. Fees for each license format are as follows:

  • Interactive Gaming License: CAD $25,000 (non-refundable) payable on application. The IGL License is valid for a period of two years and renewal fees are currently set at CAD $10,000.
  • Client Authorization License: CAD $25,000 (non-refundable) payable on application. Client Authorization Licenses are renewable every 2 years, at a cost of CAD $10,000.
  • Key Person License: CAD $5,000 (non-refundable) payable on application. Key Person Licenses must be renewed annually at the same fixed License cost.

Kahnawake Gaming Commission sets out clear prerequisites for all three licensing formats. In order to qualify for an Interactive Gaming License, service providers must agree to complete hosting of services by KGC's subsidiary data specialists Mohawk Internet Technologies, managed under Continent 8 Technologies and recognized by eCOGRA. Submission of financial documents, including tax liability and financial history is also required, coupled with an approved business plan and details of all other jurisdiction licenses held. KGC will thus carry out a Due Diligence Investigation and RNG (Random Number Generation) Software review, followed by financial audits where necessary. A Final Hearing is held on conclusion of the investigation, which can take anywhere upwards of 3 weeks to complete.

On July 26, 2011, casino and sportsbook giant Bodog announced plans to withdraw all services from the US market. Licensed by the Morris Mohawk Gaming Group until December 2011, the company revealed their initial application for Bodog UK to operate from the British Isles had been a success. It is believed that Morris Mohawk Gaming Group will launch their own brand in January 2012. Bodog's withdrawal from the US came as little surprise to some, since Kahnawake Gaming Commission confirmed its intention to tighten regulation after an eCOGRA review in February 2010. This included its present stance on licensed companies offering services to the US market.
